EPA cites Wolf Paving for clean-air violations

CHICAGO (Aug. 14, 2008) - U.S. Environmental Protection Agency Region 5 has filed an administrative complaint against Wolf Paving Co. Inc., 612 N. Sawyer Road, Oconomowoc, Wis., for alleged Clean Air Act violations at an asphalt plant the company owned and operated until January 2007 at Highway 18 and County Road C in Genesee, Wis. EPA proposed a $114,740 penalty.

EPA alleges that Wolf Paving failed to comply with particulate (smoke, ash, dust) emission limits from the plant from Oct. 13, 2004, to Sept. 8, 2005, in violation of federal performance standards for hot mix asphalt facilities.

The alleged violations were discovered when Wolf Paving responded to an EPA information request for results of performance tests conducted since Jan. 1, 2003. EPA notified Wolf Paving in December 2007 that it believed the company had violated the Clean Air Act.

Wolf Paving has 30 days from receipt of the complaint to file an answer and request a hearing. The company may request an informal conference with EPA at any time to discuss resolving the allegations.

Inhaling high concentrations of particulates can affect children, the elderly and people with heart and lung diseases the most.
