GUILTY PLEA IN ILLEGAL SEWAGE DISCHARGE IN KENTUCKY
Nathan R. Koons of Floyds Knobs, Ind., pleaded guilty on May 23 to violating the Clean Water Act. Koons was a foreman for Aqua Pro, an industrial services business operating in Western Kentucky. He directed his employees to discharge 300,000 to 400,000 gallons of sewage sludge into Downs Creek in Jefferson County, Ky., without a permit from Feb. 16-18, 1999. The sludge came from a wastewater treatment plant that was being decommissioned. Sewage sludge often contains E. coli and pathogenic bacteria which can harm aquatic life and can cause intestinal and other infectious illness in people who ingest or otherwise come into contact with the sludge. When sentenced, Koons faces a maximum sentence of three years in prison and/or a fine up to $250,000. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the Kentucky Division of Water. The case is being prosecuted by the U.S. Attorney’s Office for the Western District of Kentucky in Louisville.
