PA ILLEGAL HAZARDOUS WASTE DISPOSAL NETS FINE AND PROBATION

FOR RELEASE: FRIDAY, AUGUST 23, 1996

ILLEGAL HAZARDOUS WASTE DISPOSAL NETS $225,000 FINE AND FIVE YEARS PROBATION FOR LOUISVILLE CORPORATION

On Aug. 16, Kelley Technical Coatings Inc. (KTC) of Louisville, Ky., was sentenced to pay a fine of $225,000 and placed on five years probation for the illegal storage and disposal of hazardous wastes in violation of the Resource Conservation and Recovery Act. Any penalty or costs of investigation paid to the state of Kentucky regarding pending state administrative proceedings will be offset against the federal fine. KTC is a manufacturer of swimming pool paints, industrial paints and coatings. KTC was found guilty of storing and illegally disposing chemical wastes which were used as solvents to clean paint manufacturing equipment. In July 1992, state inspectors discovered over 600 drums of waste-paint related materials at one of KTC's plants. Many drums were rusty, leaking or open and contained ignitable materials. Federal and state law prevents the storage of hazardous waste for more than 90 days. The wastes contained a variety of hazardous chemicals including xylene, ethyl benzene and toluene. Arthur Sumner, vice president in charge of manufacturing for KTC, was convicted by a federal jury on March 29. He is awaiting sentencing. The case was investigated by EPA's Criminal Investigation Division, the FBI and the State of Kentucky Cabinet for Natural Resources and Environmental Protection.
