Statement on U.S. Court of Appeals Decision on Acid Rain Pollution Regulation for Electric Utilities

November 29, 1994

The Court's decision appears to have turned on a narrow, technical issue -- the definition of the term "low nitrogen oxide burner technology." The Agency is assessing today's decision, which applies to a limited group of electric utility boilers. We are committed to moving quickly to resolve the issue and protect public health from acid rain-causing chemicals in a common sense way.
