EPA FINALIZES REVISIONS TO IMPORTED GASOLINE REQUIREMENTS


EPA has issued a revision to the requirements for importing conventional gasoline into the United States. This final rulemaking is consistent with the Agency's commitment to fully protect public health and the environment and with the United States commitment to comply with its obligations under the World Trade Organization agreement. Under this final rule, any foreign refiner can choose to petition EPA for an individual baseline reflecting the volume and quality of gasoline shipped to the United States in 1990. The foreign refiner is required to meet the same standards relating to the establishment and use of individual refinery baselines as domestic refiners, with additional requirements. The additional requirements relate to: tracking the movement of gasoline from the refinery to the U.S. border; monitoring compliance with requirements that apply to parties outside the United States; and enforcement actions to correct violations. EPA will monitor the quality of imported conventional gasoline, and if it exceeds a specified benchmark, EPA will apply appropriate remedial action. Under this final action, the baseline for gasoline imported from refiners without an individual baseline would be adjusted to remedy any such exceedance.
