The Metalite Corporation (Metalite), which operated an aluminum anodizing facility in New Albany, Ind., its president and owner, Marvin Friedman, and his son and a Metalite vice president, Wayne Friedman, were sentenced on Feb. 20, for Clean Water Act (CWA) offenses. In 1994, Metalite illegally discharged industrial process wastewater contaminated with high levels of acid into a wooded area. The contaminated wastewater drained into a tributary of the Ohio River. The company was fined $300,000 and ordered to pay $20,000 restitution to the state wildlife fund, as well as $5,000 restitution to the City of New Albany. Marvin Friedman was fined $15,000 and sentenced to six months home confinement for his guilty plea. Wayne Friedman was fined $10,000 and was also sentenced to six months of home confinement. The prosecution resulted from an investigation by the Indiana Inter-Agency Environmental Crime Task Force, made up of EPA’s Criminal Investigation Division, the Indiana Department of Natural Resources, and the FBI with the assistance of EPA’s National Enforcement Investigations Center. The case was prosecuted by the U.S. Attorney’s Office in Indianapolis.
