EPA Issues Notice of Proposed Administrative Penalty Assessment

The U.S. Environmental Protection Agency (EPA) Region 4 announced today that an Administrative Complaint was issued to Dr. Arturo Macasinag, and EPA intends to assess an administrative penalty in an amount up to a maximum of $137,500 under the Clean Water Act. 

EPA alleges and is seeking administrative penalties against Mr. Macasinag for the unauthorized discharge of dredged and/or fill material into waters of the U.S., which is in violation of the Clean Water Act.  It has been determined that Mr. Macasinag and/or other persons acting on behalf of Mr. Macasinag, discharged dredged and/or fill material in association with a residential development into approximately three-quarters of one acre of forested wetlands.  The unauthorized discharges are located in waters adjacent to Big Lake which is a tributary of the Waccamaw River, near the City of Conway, in Horry County, South Carolina. 

The Administrative Record, including information submitted by Mr. Macasinag, is on file at the U.S. EPA Region 4 office in the Sam Nunn Atlanta Federal Center at 61 Forsyth Street SW Atlanta, GA 30303.  The file will be open for public inspection between 9:00 am and 4:00 pm on weekdays.
