EPA'S OFFICE OF SOLID WASTE HOLDS TWO PUBLIC MEETINGS

EPA's Office of Solid Waste will hold two public hearings next week at the Key Bridge Marriott, 1401 Lee Highway, Arlington, Va. On June 3, there will be a public hearing on the Advance Notice of Proposed Rulemaking (ANPR) for Corrective Action for Releases From Solid Waste Management Units at Hazardous Waste Management Facilities. In the ANPR the Agency announces its strategy for promulgating regulations governing RCRA corrective action and requests comments and information to assist in identification and development of improvements to the protectiveness, responsiveness, speed and efficiency of the corrective action program. The Agency is requesting comments on a broad range of corrective action issues including: general implementation of the program and suggestions for improvements; consistency between cleanup of RCRA corrective action and Superfund sites; voluntary cleanup; future land use; points of compliance; expanding opportunities for public participation; measuring and enforcing corrective action performance standards and state authorization. On June 4 there will be a hearing on the proposed Requirements for Management of Hazardous Contaminated Media, more commonly referred to as the Hazardous Waste Identification Rule for Contaminated Media or HWIR-media. The proposal was published in the Federal Register on April 29. This proposal would address contaminated media (including soils, groundwater and sediments) that are currently subject to regulation as hazardous waste under RCRA, and are managed during government-overseen remedial actions. The proposal's purpose is to develop more flexible management standards for media and wastes generated in the course of site cleanups. To accomplish this objective, the proposal would establish modified land disposal restriction treatment requirements and modified permitting procedures for higher-risk contaminated media that remain subject to the hazardous waste regulations; and give EPA and authorized states the authority to remove certain lower-risk, contaminated media from regulation as hazardous wastes under most of Subtitle C of RCRA.
