ILLINOIS TRAILER COMPANY SENTENCED FOR RCRA VIOLATION

On March 21, the U.S. District Court for the Central District of Illinois sentenced E-Z Trail Inc., of Arthur, Ill., to five years probation, a fine of $100,400 and ordered it to pay $97,112.21 in clean up costs following its guilty plea to felony charges of disposing of hazardous wastes in violation of the federal Resource Conservation and Recovery Act. The company buried approximately 40 55-gallon drums of hazardous solvents containing highly flammable xylene and toluene and lead-base paint wastes on its property between November 1991 and September 1992 without a disposal permit. Xylene, toluene and lead are substances which have been linked to a variety of illnesses in humans. E-Z Trail was also required to take out a fullpage advertisement publicizing the violation and describing the steps it will take to prevent a recurrence, and to develop an environmental compliance training program for its employees. This case was investigated by EPA's Criminal Investigation Division, the Small Business Administration, the Illinois State Police and the Illinois Environmental Protection Agency with assistance from EPA's National Enforcement Investigations Center.
