EPA SEEKS $2.5 MILLION PENALTY AGAINST HEWLETT PACKARD FOR TOXIC SUBSTANCE CONTROL ACT VIOLATIONS
EPA filed an administrative complaint with the Office of the Administrative Law Judge at EPA Headquarters, against a Hewlett Packard Corp. facility in Corvallis, Ore., on Sept. 30 for violating the federal Toxic Substances Control Act (TSCA). The complaint seeks a $2.5 million civil penalty alleging that the company has been manufacturing and exporting chemicals prior to completing a Pre-manufacturing Notice (PMN) as required under the law. The PMN chemicals involved with this complaint include a part of the ink that is used in inkjet printers. A PMN requires a company to provide EPA with a chemical toxicity review before bringing a new chemical into commerce. If manufacturers of new chemicals do not follow the TSCA requirements, the Agency cannot conduct a risk analysis, potentially exposing the public and the environment to unknown risks. This case was investigated by the Office of Enforcement and Compliance Assurance and Region 10 in Seattle.
