LOUISIANA MAN ORDERED BACK TO PRISON
On May 9, Edward W. McCrary III, of Baton Rouge, La., was sentenced to serve 10 months in federal prison for violating the conditions of his supervised release. McCrary had previously served 27 months after he pleaded guilty in 1993 to one count of illegally discharging pollutants in violation of the Clean Water Act and one count of conspiracy. After his release from prison, McCrary was on three years supervised release during which he had been ordered by the federal court not to engage in any type of business, occupation, or profession which would involve the treatment, storage or transportation of pollutants or hazardous waste, unless he received prior approval by the court. Special Agents of EPA and Special Investigators of the Texas Natural Resource Conservation Commission reported to the court that McCrary was engaged in the business of selling toluene, a contaminated hazardous solid waste to gasoline blenders or manufacturers without prior court approval. It contained approximately five percent hexamethyl disiloxane, which forms ash deposits in automobile engines that make spark plugs inoperative. Automobile owners have made more than 400 claims as the result of using gasoline made with the contaminated toluene.
