In the first case ever in which a rental property manager was prosecuted for failing to notify a tenant about a lead-based paint hazard, James T. Aneckstein of Manchester, N.H., has been sentenced to 15 months imprisonment. Aneckstein and his company, JTA Real Estate Brokerage and Property Management Inc., previously pleaded guilty to obstructing justice, making false statements and failing to provide tenants with notice of lead-based paint hazards. Aneckstein and JTA were also ordered to pay a $40,000 fine. The defendants failed to warn the mother of a two year-old about the lead hazards in her Manchester apartment and the child subsequently died of lead intoxication on April 21, 2000. As a result of the conviction, the defendants have hired an independent contractor who determined where lead-based paint hazards existed in their owned properties and have provided all tenants with new lead-based paint notices. The case was investigated by EPA’s Criminal Investigation Division with forensic assistance from the U.S. Secret Service. It was prosecuted by the U.S. Attorney’s office in Concord.
