THREE INDICTED IN INDIANA FOR ILLEGAL WATER DISCHARGES

Metalite, a Kentucky corporation with an aluminum coating facility in New Albany, Ind.; Marvin Friedman, a former owner, president and operator of Metalite, and Wayne Friedman, a vice president and operator of Metalite; were all indicted on July 14 in U.S. District Court for the Southern District of Indiana in Indianapolis on charges of violating the Clean Water Act. The charges allege that in August and September 1994 and in June 1996, the defendants knowingly discharged acidic chemical waste and industrial process wastewater into an unnamed tributary of the Ohio River. Acids and industrial wastes can be harmful to fish and other aquatic life. If convicted on all charges, Marvin Friedman and Wayne Friedman each could face a maximum sentence of up to 22 years in prison and/or fines of up to $2,750,000. Metalite could face a maximum fine of up to $5,500,000, if convicted. The investigation was conducted by EPA’s Criminal Investigation Division with the assistance of EPA’s National Enforcement Investigations Center, the FBI, the Indiana Department of Natural Resources, and is being prosecuted by the U.S. Department of Justice.
