EPA SEEKS COMMENTS ON PROPOSED RULE CHANGES TO SAFE DRINKING WATER ACT VARIANCES AND EXEMPTIONS
EPA is seeking comments to proposed revisions to the Variances and Exemptions regulations, which were published on April 20, in the Federal Register. These revisions are in response to the 1996 Amendments to the Safe Drinking Water Act. Under certain conditions, where no unreasonable risk to health is posed, EPA or states may grant variances to allow public water systems to use specified, less costly technology, when the system can not afford technology that results in full compliance with existing maximum contaminant levels or treatment technique requirements. EPA and states may also grant exemptions to allow public water systems with compelling circumstances more time to comply with a new regulation when public health is not at risk. EPA is also proposing the creation of a new Subpart under the regulations that describe the conditions and procedures under which a EPA Regional Administrator or primacy state may issue variances to public water systems serving less than 10,000 persons. A primacy state has primary enforcement responsibility under the Safe Drinking Water Act.
