DELAWARE CONSTRUCTION COMPANY INDICTED FOR VIOLATING THE RESOURCE CONSERVATION AND RECOVERY ACT

Pettinaro Construction Co., (PCC) of Wilmington, Del., was indicted on June 9, in U.S. District Court for the District of Delaware in Wilmington on two counts of violating the Resource Conservation and Recovery Act. PCC is alleged to have illegally stored wastes that were ignitable, toxic and corrosive at a Wilmington warehouse between October 1995 and April 1996. The defendant is further charged with illegally transporting the wastes in a van before they were abandoned in a parking lot near the Wilmington Train Station. The wastes contained acids and flammable liquids, all of which can cause serious burns. If convicted, PCC faces a maximum fine of up to $500,000. The case was investigated by EPA’s Criminal Investigation Division working with the Delaware Environmental Crimes Task Force.
