COST RECOVERIES FOR BAYOU BONFOUCA SUPERFUND SITE

On July 31, the U.S. District Court for the Eastern District of Louisiana entered a $3.6 million Comprehensive Environmental Response, Compensation and Liability Act cost recovery consent decree between the United States and Fleming American Investment Trust (FAIT), in connection with the Bayou Bonfouca superfund site. The 55-acre site, located in Slidell, La., was a wood preserving facility operated by the former American Creosote Works and Gulf States Creosoting Co. until its closure in 1972. Under a June 25 consent decree the Kerr-McGee Chemical Corp. agreed to pay $20 million for reimbursement of response costs at the site. Kerr-McGee and FAIT have also reached settlements with the state of Louisiana for $1.5 million and $400,000 respectively.
