HAZARDOUS WASTE AND WEAPONS CHARGES AGAINST CALIFORNIA MAN

Art Krueger of Loomis, Calif., was sentenced on Dec. 19, in U.S. District Court for the Eastern District of California in Sacramento to 21 months incarceration, and was ordered to pay $13,976 in restitution for his July 1997 conviction for the illegal storage and transportation of hazardous wastes and wire fraud. In 1993, the Sacramento fire department discovered illegally stored hazardous waste during an inspection of a warehouse leased by Krueger and convicted co-defendant, Frank Fiorillo. A further search of the warehouse uncovered 100 rocket motors and warheads containing 7,500 pounds of explosives, and approximately 17,000 155mm artillery shells, which had been obtained without proper federal permits. Krueger and Fiorillo operated Safewaste and West Coast Industries Inc., in Sacramento, Calif. Safewaste had contracted to handle hazardous waste for Diversey Inc., a national manufacturer of cleaning chemicals located in Michigan. Krueger provided Diversey with false certificates of disposal for the waste, which was hauled to the Sacramento warehouse operated by Fiorillo and himself. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the Bureau of Alcohol, Tobacco and Firearms, with the assistance of EPA’s National Enforcement Investigations Center.
