WASHINGTON COMPANY OWNER CHARGED IN HAZARDOUS WASTE CASE

Brett Simpson, owner and operator of TDS Northwest Inc. (TDS), a farm equipment manufacturer, pleaded guilty on Oct. 19, in U.S. District Court for the Eastern District of Washington in Spokane to illegally disposing of hazardous waste in violation of the Resource Conservation and Recovery Act. The defendant buried drums of waste oils and solvents in a pit near the town of Kittitas, Wash. Many of the drums had been crushed allowing the contents to drain into the soil. Simpson directed TDS employees to dispose of the drums on property he owned. The maximum sentence for illegally disposing of hazardous waste is up to five years imprisonment and/or a fine of up to $250,000 per count. This case was investigated by EPA’s Criminal Investigation Division and the Washington State Department of Ecology.
