MARYLAND MAN TO PAY FOR CLEANUP

Leon McKemy, owner and operator of M&M Fuel Co. in Edgemere, Md., was ordered on June 30 to pay $60,000 in cleanup costs by the U.S. District Court for the District of Maryland in Greenbelt, Md., to violating the Clean Water Act. M&M is a home heating oil delivery company. From January 18-20, 1996, more than 1,300 gallons of oil stored in a fuel tank at the M&M facility leaked and flowed into a storm drain which emptied into Jones Creek which is a tributary
of Chesapeake Bay. M&M did not have a permit to store the oil in the tank and the tank did not have a berm or dike constructed around it to contain oil spills. The discharge of oil into surface waters can render them unusable as drinking water sources and is harmful to fish and other aquatic life. In addition, McKemy failed to notify authorities concerning the spill, as required by law. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the United States Coast Guard.
