U.S. District Court Decision on U.S. V. Caterpillar, Inc. and U.S. V. Detroit Diesel Corporation Victory for Clean Air and Public Health

The U.S. District Court for the District of Columbia denied motions by Caterpillar and Detroit Diesel Corporation requesting modifications of the consent decrees that would delay the October 1, 2002 deadline for implementation of tighter emission limits for diesel truck engines manufactured by the companies.

EPA Administrator Whitman issued the following statement in response to the decision.

“We are pleased with the court’s decision supporting EPA’s position against modifying the consent decrees for Caterpillar, Inc. and Detroit Diesel Corporation. The court’s decision ensures that the new emission limits will be implemented by October 1, 2002.

“EPA believes the public deserves clean and reliable diesel engines. These new limits will provide for substantial reductions of nitrogen oxides which are a major contributor to ozone pollution and a serious threat to public health.

“We will continue to work with the engine manufacturers to ensure a smooth transition to the new engine technology, and expect a full range of reliable engines meeting the requirements to be certified by October 1.”
