Black Diamond Engineering Settles over Alleged Federal Clean Water Act violations

(Sandpoint, Idaho – March 31, 2008) Black Diamond Engineering (Black Diamond) has agreed to pay a $1,277 penalty to settle an enforcement case with the U.S. Environmental Protection Agency (EPA) for alleged violations of the Clean Water Act (CWA). The alleged violations occurred at the Cedars at Sand Creek construction site (Site), located at 400 Schweitzer Cutoff Road in Sandpoint, Idaho.
The complaint contained the following alleged violations of EPA’s Construction Storm Water General Permit (CGP):
- Numerous Storm Water Pollution Prevention Plan (SWPPP) deficiencies;
- Failure to conduct a number of inspections;
- Failure to properly sign/certify the inspection reports; and
- Failure to install or maintain silt fences at the site.
In the complaint, EPA did not allege that an unauthorized discharge to Sand Creek had occurred.
“The NPDES permit is in place to help prevent water runoff from construction sites from polluting our lakes, rivers and streams,” said Jim Werntz, EPA’s Idaho State Director.
The storm water permitting program is a “key tool” to preventing water pollution and an important way that Idaho’s lakes, rivers and streams are protected against polluted runoff from construction sites.
