GEORGIA UTILITY COMPANY PLEADS GUILTY

Dalton Utilities, a municipally-owned utility company in the city of Dalton, Ga., pleaded guilty on Sept. 9, in U.S. District Court for the Northern District of Georgia to falsifying wastewater analysis in its monthly operating reports in violation of the Clean Water Act. The plea agreement calls for the defendant to pay $500,000 of a $1 million fine and improve its environmental compliance. If Dalton Utilities does not fully comply with the terms of its probation, it will be required to pay the remainder of its fine. The case was investigated by EPA’s Criminal Investigation Division, the FBI, and the Georgia Department of Natural Resources with assistance from the Department of Transportation, the Federal Emergency Management Agency, and the Georgia Attorney General’s Office. It was prosecuted by the U.S. Department of Justice.
