KENTUCKY ENVIRONMENTAL AND MANAGEMENT COMPANIES SENTENCED FOR ILLEGAL ASBESTOS REMOVAL
On Oct. 3, Barry Shurelds of Philadelphia, Pa.; Sam Robinson of Philadelphia, Pa.; Sean Shurelds of Camden, N.J.; Hosea Eusebio of Jersey City, N.J.; the IES Lead Paint Division and its parent corporation, IEMC Environmental Group Inc., were sentenced in U.S. District Court for the Eastern District of Kentucky in Lexington for violating the Clean Air Act. Barry Shurelds, project manager, was sentenced to 51 months in prison; Robinson, the on-site supervisor, received a 10-month sentence; Sean Shurelds and Eusebio received probation; and the companies are out of business and were not fined. The defendants were convicted of removing asbestos-containing material from the Hess Department Store in Louisville in early 1993 without following federal regulations that prevent exposure to workers and the general public. When inhaled, asbestos fibers can become trapped in the lungs which can lead to lung cancer and a lung disease called “asbestosis.” Crown American Corp., the owner of Hess Dept. stores, was ordered by the Kentucky Department of Environmental Protection on March 10, 1993 to conduct an emergency cleanup which costs Crown American approximately $1 million. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the Kentucky Department of Environmental Protection.
