ALABAMA MAN CHARGED WITH FALSIFYING CLEAN WATER ACT REPORTS

J. Daniel Bell, of Foultondale, Ala., a former environmental manager of the now-razed Koppers Industries Inc., coke plant facility in Dolomite, Ala., was charged with violating the Clean Water Act by falsifying discharge monitoring reports (DMRs) that were sent to the Alabama Department of Environmental Management. DMRs are required to assure that a facility is not violating the limits set in its wastewater discharge permit. Falsifying DMRs can make it difficult for environmental regulators to determine if surface waters are being protected and are safe for humans, fish and wildlife which use those waters. If convicted, the defendant faces a maximum sentence of up to 36 months in prison and/or a fine of up to $250,000. The case was investigated by EPA's Criminal Investigation Division with the assistance of the FBI. It is being prosecuted by the U.S. Attorney's Office in Birmingham.
